A closer look at Ntreev’s TOS

Ntreev USA added an update to the Pangya site about their privacy policy & terms of service. It’s a pretty standard TOS, if you fuck with us, we’ll ban your ass type of deal. However here are some interesting tidbits that I picked out.

The Company will not be liable for any loss or damage that you may suffer as a result of someone else using your Account, either with or without your knowledge. You will be liable for any and all losses incurred by the Company and/or any of its licensors due to someone else using your Account.

So basically if someone hacks your account, too fucking bad? 😐 I mean they do warn you not to give your pw out to hackers/scammers, but with the way A18 was handled, it seemed like hacking was as easy as 123 even if you didn’t actually ever give your password out to anyone. Kinda makes you think twice about spending hundreds of dollars on ecards right?

The Company makes no representation that the Services available on the Site are appropriate or available for use in locations outside of the United States. Accessing the Site from territories where the Services are illegal is prohibited. If you choose to access the Service from locations outside of the United States, you do so (i) on your initiative, (ii) at your own risk, and you acknowledge and agree that you are responsible for compliance with local laws if and to the extent local laws are applicable.

This basically confirms that Pangya is meant for the USA. This is similar to what Europe said for GOA – you guys can play outside Europe, but if something happens, we don’t give a damn. I have a feeling that all the foreign language bullshit that went on A18 isn’t gonna go down here. Or so I hope anyway. This doesn’t say that they are going to ban anyone outside the US, but I have a feeling if a certain country continues to cause trouble, there may very well be a ban…who knows.

The worst part I think is their disclaimer:

THE COMPANY DOES NOT WARRANT OR GUARANTEE THAT THE SITE OR ANY CONTENT, SERVICES OR FEATURE OF THE SITE WILL BE ERROR-FREE, RELIABLE, UNINTERRUPTED OR AVAILABLE AT ALL TIMES, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE OR ANY OF THE SERVICES WILL PROVIDE SPECIFIC RESULTS. THE SITE, THE SERVICES AND ALL CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS.

So basically if there’s maintenance, and there’s bugs, and they don’t care…too fucking bad. I really hope it’s just a disclaimer, rather than an accurate reflection of what kind of service they will be providing to us. Considering that Season 4 was a bug fest both in Korea & Japan, I’m almost scared to see what happens if the US server eventually gets it. A week of maintenance with no servers being up? Yea I can possibly see that. Oh well let’s keep our fingers crossed.

It sounds like there is hope for Ntreev after all if they have actual fun events instead of bullshit LCD monitor ones 😆

    sounds ok for me, or better saying. sounds like i`ll be able to play for like… 2 months or so, after that they will prolly ban brazil`s IP range.

    after this, i guess i`ll be buying a PSP @_@

Business wise, no company is stupid enough to make themselves contractually liable for bugs, server downtime or the hacking of your account – all it would take is a rich trustfunder (and there seems to be a LOT in MMOs for some reason…) willing to retain a lawyer to enforce such a TOS against them and they would be losing a lot of money. For this reason, TOS are not for the user’s protection, but for the company’s protection (especially see where they hold YOU liable if THEY somehow lose money by someone accessing your account illegitimately – I personally think this is the most suspect term of all).

    With that said, Pangya Japan has a very similar TOS (https://www.gamepot.co.jp/gic/regist/pangya/agreement.html) yet have a really high level of customer service, in my experience anyway. (I don’t think you can blame them for s4 bugs, that would have been the domain of Korean Ntreev programmers.)

    At the end of the day, the TOS does allow NtreevUSA to put up their feet and let the server be consumed by hackers, cheaters, and other such unwanted persons. This is not dissimilar to other games. However, if they do act in this way, the game will definitely not be as successful as it might be and hopefully they realise this.

    I’m not sure if I’ll play PangyaUSA as I’m quite busy nowdays but after playing Trickster for a while some months ago, I don’t think you have anything to worry about Hinano. Yeah, there were constant cash shop updates, but those are dictated by Korea anyway (and Pangya is similar, in all regions). There were frequent events (the reason why, IMO, that a18 kinda sucked – no events!) and the servers were run pretty smoothly with GMs appearing in the main town after updates asking the players if there were any bugs. Then again, this was some months ago and I never had to use the support system (I did hear they never replied to 1:1 service requests – though I never saw many “OMG NTREEV STOLE MY MONEY I GOT HACKED WAHH posts, most of them seemed to be about event items never recieved) so I’m not sure if they still operate like this.

    Finally, I think that now Korea has direct control over PangyaUSA, the service level will increase. Going back to Trickster again, Ntreev actually distributed tasks amongst service regions, for instance, USA was responsible for quests (IIRC – probbaly wrong) and China was responsible for lottery character boxes (this one I know is true). So you might see some tailor made events for PangyaUSA (and not the rubbish, “WIN A LCD MONITOR FOR PLAYING 100000 HOLES!!!!!!!!!11111one”).

    Ugh, I rambled, so hopefully people had the patience to read all that but…

    TL;DR – In the end, it comes down to NtreevUSA being a good service provider and providing the support that customers deserve rather than the support they are contractually entitled to (almost nothing).

  5. Dang that’s a lot. I only spent about $80, which to me is still a lot considering I feel like our accounts will not be transferred but that’s another story.

    What’s funny is in that thread they’re all talking about like “LOL THIS IS SUCH OBVIOUS TOS EVERYONES TOS IS LIKE THIS!” but then you’ll get all these people complaining how OGP never “fixed bugs” and never “took care of the hackers” and basically this TOS states that Ntreev has every right to act in the same fashion – but it seems the forum crowd is too stupid to grasp this concept (or the point of my post while we’re at it.)

  6. Good on you, pretty spineless for them to leave a comment behind your back. I agree with your statements; especially with the European one. I’ll be pretty pissed if the enforced a banning after I spent £500 (Around $1000) over the many years of playing that God forsaken game.

In addition, if they have something to say to me, they should come and say it here instead of bitching about it on the forums 🙄

  8. i’d imagine WOW is more strict mainly because it has such a massive player base. I mainly posted this because there’s so many idiotic threads on the forums lately that I stopped visiting them and keeping up alltogether. A lot of their “questions” can be answered in the TOS it seems which is probably why Ntreev pointed to it in their updates.

  9. Account “hacking” is generally caused by key loggers and stupid kids giving out their account info. Your concerns are valid, but supported by hysteria and misinformation. The key to keeping your account safe is practicing good computer safety routines like checking for viruses with a good anti-virus and checking for spy-ware with a good anti-spyware app. Ntreev has been known for helping out, but ultimately it’s the player’s fault. Hell, Blizzard only gives you three account restorations no matter what the circumstances.

    The last bit is really a CYA measure that you’ll find in just about any ToU right up to Blizzard’s mighty iron-clad ToU. Heck, you want scary? Read the ToU for World of Warcraft. This one is downright friendly in comparison.
